I’ve been a member here for over a year and have found you be of great help.
I’m hoping you can help with this one.
My wife receives a letter and a ESA3 which
states the following
(You are getting contribution based employment and support allowance (ESA)
We need to look at your claim to decide if you might also be eligible for income related
ESA from 25 Sept 2012.
If you are you may be entitled to extra payments.
These are called premiums.
They state that the ESA3 has to be returned
by 18/08/2018.
But it also states at the bottom the following
(You do not need to fill in this form is during the whole time between (BLANK) and now
you had or have a partner and they were or they are working over 24 hours a week
you had or have savings over £16000)
This because you will not qualify for income related ESA

The problem with this ESA3 form is
She won’t qualify as I’m working 26 hours a week and my questions are
Does this ESA3 have to be returned
Can we ignore it
What will happen if it is ignored
Will they stop her money
On the front of the form it states
Why we have sent you this form
It says because there is a change in circumstances or you want to claim income related employment and support allowance
Yes her condition has become worse but they don’t know that and she didn’t apply for the above
Or do we contact them, we are afraid to do this
You know what they are like they may ask for it to be completed and sent anyway.
I would appreciate your advice on this.

Were you working 24 or more hours a week when your wife was transferred to ESA?

You don't have to complete the form but if you don't intend to then contact the DWP to tell them this.

Thanks Gordon for the quick reply yes I have been working
Do I just ring them and tell them that she would not be eligible because I’m working more than the 24 hours
Will they just forget about the form of stop her money or ask for it to be compliant way

Just contact the DWP office dealing with her claim and explain that you have been working more than 24 hours a week since she transferred to ESA, it should not be an issue and there is no reason why her payments would be affected.
