Tribunal decision was created by Jane Flack
Hi,
My daughter was moved from the support to wrag group of esa in oct17. As her appointee I appealed the decision and last week the tribunal upheld my appeal.
The letter from the tribunal states that the decision is not binding on the Secretary of State.
In reality how likely is it that they will not revise the decision? And what would the next steps be to take?
Also if decision is revised would the additional payments due be backdated to October 17?

Just to confirm, your daughter was placed back in the Support Group by the Tribunal panel.
If this is correct then I am not sure why the Decision Notice says this, this wording is used for a WRAG award as payment is dependant on the claimant's circumstances but these issues do not apply to an SG award.
The Tribunal Decision applies from the date of the Decision that was appealed so if that was October 2017 then this will be when back payments will apply from.
It normally takes the DWP 5-8 weeks to process a Tribunal result, I would give them a call to make sure that they have received the Tribunal Notice.
