This question relates to DLA to PIP. If you make an appeal and the appeal results in your award getting reduced, do you have to pay back the overpayment for the period from the original award to the award decided at appeal?
Specifically for an appeal, if the panel feels that your existing award is not supported by the evidence available to them, then the Judge in charge of the panel must warn you and allow you an opportunity to withdraw your appeal.
If the award is reduced or removed then it is no normal practice to recover the monies paid, however, if the reason that the award is revised down is that you have misled the DWP or failed to provide relevant information then it recovery is an option.
