Hi
After waiting 9 months for a tribunal date at Manchester, it was adjourned pending my GP records being requested from the Judge who stated my case was complex.
I had submitted dozens of specialist evidence and was claiming ESA (support group).
After moving to Todmorden my case was moved to Burnley tribunal and I am now living in a full service UC area. .Had my hearing 25th September 2018.
The judge said I would hear by post as they appeared to be concerned by the time they had already taken.
Decision letter came on 27th my appeal has been refused. after waiting nearly 2 years. I have requested the statement of reasons and have the relevant form ready. my representative is not very optimistic about this process, any suggestions?

You can claim UC, subject to your meeting the eligibility criteria and ask to be assessed for Limited Capability for Work, this is basically the same as making an ESA claim.

You can wait to see what the SoR says but you are not entitled to the ESA Assessment rate whilst appealing to the UTT.

Have you looked at claiming PIP?

So you can make a new claim for PIP immediately, there is no waiting time but you will need to consider how you might get an award given the problems you have had with your original one.

HI I Just phoned appeal court to ask about mine, its now been 61weeks and thay said again I will be hearingabout it very soon. this is the onlt responce i ever get from them (your hear very soon). hope your hearing go`s well and you won`t have to wiat much longer.
