Entitlement to Contributory ESA was created by am66
Hi, please can someone help. I have been receiving income based ESA (in support group) for many years due to long term illness/disability that will not get better. My partner and I are considering moving in together, he works full time.I would then no longer be eligible for income related ESA but would I be able to claim contributory ESA? I have looked up on HMRC and have been credited with 52 wks of national insurance credits for the years I have been claiming ESA (this has been paid by DWP I presume) does this count as contributions for contribution based ESA ?

If you are not already receiving Contribution Based ESA, this could be ESA(CB) with an ESA(IR) top-up, then you will not be able to claim it now.

The NI Credits that you have received from your ESA claim can be used in part to claim ESA(CB) but you also need NI Contributions and these can only be obtained through employment. Did you work in the Tax Years 2015-16 and 2016-17?

Hi, Thank you for the info regarding name :) I wasn't aware. No I have not worked in the last few years. Thank you for your help
