Hi Gordon,

I recently had my WCA (work capability assesement) conclude I score 0 points
and am 'Fit for Work' from 28-11-18 (after about 6yrs in wrag esa). Having a right nightmare over MR (mandatory reconsideration) as I know this is my last chance to save my esa award, etc, as my area is Full UC, and my HB is suspended.from decision date.

Q. Can you tell me if/how/when I would be able to get housing benefit without claiming UC?
Is it only possible at the Tribunal acceptance date ? (and/or with a decision change)
Can I still claim esa (at assesement rate) upto FTT (and try fend off, or claim, UC), and if so, also get some HB reinstated ??)

The key issue will be whether, at any time, you need to make a new claim for HB. If you do then you will be forced onto UC, however, if you are able to continue your existing claim for HB then you won't.

You can make what is called a nil income claim for Housing Benefit but I am unsure whether this can be done without you having to claim UC, contact your Local Authority to see whether it will be accepted or not.

If the Decision is not revised at the MR stage and you go on to appeal then you can ask for your ESA to be reinstated at the Assessment rate and this will allow an HB claim as well.
