Pension Credit refused Advice please was created by Andyb53
Having recently turned 65, I applied for Pension Credit. I am in receipt of PIP and receive the enhanced rate for mobility and daily needs. I also get a state pension of £170.15p per week and a tiny private pension of £26.45p pw. I have done the DWP's own Pension Credit Calculator that says I em entitled to £30.25p pw Yet the DWP say I am not entitled. Apparently because there is another totally independent, in every respect, (physically, emotionally and financially), living within the 4 walls of my property, they say I am not living alone! On that basis any block of flats or house of Multiple Occupancy would be the same? I live alone and the other person in the house has own entrance and I hardly ever see them. This has been checked by DWP visit. Are the DWP right or do I have grounds for appeal? Help / advice much appreciated

This is certainly a challengable Decision but you will need to provide evidence that you living alone, for example; do they have their own rent book? Do they have their own rooms, only sharing areas such as the kitchen and bathroom?

Thank you for your reply. I forgot to add that I had a DWP home visit and the inspector saw the way I live and confirmed that we were not in ANY WAY a "couple" or "Partners" When I questioned the result I was told that the fact that someone else was living within the same 4 walls meant I was not living alone. Very confusing! What would happen if I had a friend stay whilst visiting the UK? Even the DWP's own Pension Calculator says Ii am entitled to Pension Credit.

As far as I can see PC uses the same definition of a household as other benefits, see the following and specifically paragraph 77100 onwards.

Gordon THANK YOU SO MUCH FOR THIS! It re-inforces my re-consideration as it basically confirms I am single and living alone.

Gordon I have downloaded the entire section you advised. What is the name of the main document that Chapter 77 is part of?
