Deprivation and Notional Income/Capital was created by P T Gadd
The purpose of this email is to ask clarification/comment on the subject matters if a person is going to receive an occupational or person/private pension
Assuming the person is already on Employment and Support Allowance and Housing and Council benefits and they decide to defer the pension, then will this be considered as deprivation of income and capital ( if lump sum payable) and if so then will notional income be assumed and applied
Your help on this would be appreciated, thank you PTG

Notional Income only applies once the claimant reaches the age to claim Pension Credit.

Notional Capital only applies if the pension is paid and disposed of in a way intended by the claimant to allow them to continue to receive benefits.

Hello Gordon,
Thank you for your reply.
I agree this seems to be the situation for ESA, however do correct me if I am wrong but for Housing or Council Benefit my investigations seem to indicate that that the subject matter will apply even if the claimant has not reached Pension Credit age

I'm afraid we don't deal with Housing Benefit on the forum, you will have to get face to face advice.
