Hi,

I was placed in the ESA support group in 2016 after winning an appeal to reopen my claim, and then passing the medical on mental health ground ( I would like to thank Gordon again for his great help during the process of my appeal in 2016.)

I received my new ESA50 last month and have some questions. I would be more than grateful, if anyone could provide some advice and guidance.

1: I am required to “ return the questionnaire by 24th June 2019”, but I could not finish and post it before the 24th. If I post it on the 24th by the special delivery, next day guaranteed, will it still be deemed as “late”? Will I be in trouble for it? Do I need to call anyone regarding the late submission?

2: I had a total hysterectomy with bilateral salping-oophorectomy last year and later became incontinent after the surgery. I am currently seeing physio and Urologist for it but don’t have a detailed report in hand, although my gynaecologist has mentioned the condition and made an Urogynaecology referral on the letter to my GP. Do I need to request a report particularly about my incontinent?
On the section 9 of the questionnaire, I say I have to wash or change my clothes, due to incontinent, more than once a week. Although I ware pad/nappy most time, but I cannot ware it all the time because I have psoriasis - prolonged pad/nappy cover would often cause skin irritation and infection.
Will I get 8 points for this part or it will be disregarded and get 0 point instead?

3: I’ve a new referral to see a psychiatric nurse, and on the waiting list to see a psychiatrist. My GP is not supportive of my claim, and I rarely see my new GP ( only just changed my GP two years ago). So at the moment I can only provide the old letter written in 2016 from my last psychiatrist ( I was diagnosed with Emotionally Unstable Personality Disorder with anxiety, depression and insomnia.) Will the letter be deemed too old as a medical evidence for my mental conditions and depression? If I cannot get to see my psychiatric nurse and have a letter from her on time for my medical, do you think my chance of stay in the support group is very small?

Hi Zoe

If you have not returned the questionnaire within 3 weeks, you should be sent a reminder. If you do not return the questionnaire within 1 week of receiving the reminder, you will be treated as not having a limited capability for work and thus not entitled to ESA unless you can show that you had good cause for failing to return it.

DWP must take into account your health, your disability and if you were outside Great Britain. You do have the right of appeal against a decision that you failed to send back a completed questionnaire but you cannot be paid the basic allowance of ESA pending an appeal on this matter.

Send in all your supporting documents you have, if you are still waiting for more information then note it under additional information but don't delay in sending it in, make sure you make a copy of the questionnaire or photograph it on your mobile if you have one and send it by recorded delivery or ask Post Office for proof of posting.

I cannot answer what your chances are in staying in the support group, it would depend on what you have written in your questionnaire and any supporting evidence you send in, remember to be placed in the support group you must be found to have 'limited capability for work-related activity'

Thank you very much for your reply, Gary.

I am anxious to know if I post my ESA50 on the 24th by the Royal Mail special delivery ( the letter says I should send the questionnaire by 24/06/19), will it still be deemed late? I would like to know that if I need to call them to ask for extension for being one day late. If I can prove that I post it on the 24th, is it still deemed late?

Hi Zoe

We can't give you a definitive answer of what they will do. If it doesn't arrive by the 24th which you say it will not, they may well deem it to be late. You need to ring them first thing tomorrow.
