ESA Decision Causing Extreme Anxiety

Hi,

I've recently after an ESA assessment been after many years in the support group moved to the work related activity group, and it's made me go into an anxiety state. I was wondering, if I got in touch with the DWP and informed them that because of the decision it has affected my mental health and made me ill, would that change anything and get them to reverse they're decision?

You can't use the change in your conditions in regard to the existing Decision, that can only consider your limitations as they were on the day that the Decision was made.

You can report a Change but you need to be aware that this will result a full reassessment of your claim, a new ESA50 and almost certainly a face to face assessment.

Before you do, make sure that the deterioration will result in your now meeting the Support Group criteria as this is not always the case, you don't want to go ahead only to find that you don't.

If you do report a Change then do it in writing to the DWP office dealing with your claim and if you can afford it, send the letter by a Tracked post so you have proof of delivery, the date of your letter will be used as the start date for any increased award.

I must say that I'm very tempted to inform the DWP of the change in my mental state etc caused by the decision I received. It might be worth it if I have to start fresh, a new claim might be the answer to getting me back in the support group where people with my illness / problems should be.

Remember, it is not the illness/condition that is being reviewed but rather the limitations that result and in relation to the ESA activities.

i got lucky with the decision maker who looked at my claim again, as i phoned the DWP this afternoon in the hope of adding more info about how my illness affects my life and was told that i've been put back into the Support Group..And there was me stressing thinking i'd have to appeal / tribunal. I'm relieved to say the least.
