What To Do was created by Tigerlily11
Hi, I would be very grateful for any advice as this has really threw us.
My husband’s work place has just became bankrupt.
He had an operation on his back last Thursday and was off on sick leave. First time in 30 years.
Who should his sick line now go to and who pays it? We have not put one in yet.
What if any benefit would he be able to claim?
Would any redundancy payment effect any benefit?
When he has recovered would he apply for Universal Credit and would this effect my benefits?
I am getting PIP enhanced rate and ESA in Support group.
Sorry for all the questions but as you can imagine this has been a shock.
Thank you so much.
Jessica

Hi Jessica
I'm sorry about the shock of your husband's company and his op. Difficult for both of you.
Sorry but the questions you ask are outside the scope of what we deal with within the forum. We are here to help people in relation to the information provided in the guides, but we aren’t able to give information on other issues.
May I suggest that you use the benefits calculator which tell you what you are entitled to

Thank you Gary and Bis for your kind words.
Maybe my husband could apply for ESA or would he need so many qualifying weeks before he could do this?

He can apply for New Style ESA
www.gov.uk/guidance/new-style-employment-and-support-allowance
He will need a minimum of 50 weeks of National Insurance Contributions in both of the Tax Years 2017-18 and 2018-19.
The potential problem is that there may be an expectation by the DWP that he should be receiving Statutory Sick Pay (SSP} which would prevent payment of the NS ESA.
