Is this because I am getting Legacy ESA and am I right in thinking if I received New Style ESA I would not be able to claim this?

You are not eligible for the Premium as you are currently not classed as living alone because your husband is not receiving a qualifying benefit, if an award of PIP Daily Living `is made then you will be considered as living alone and the SD Premium will become payable.
There are no Premiums payable with New Style ESA.

Hi everyone,
I was recently awarded a top up of income related ESA on top of my Legacy Contribution based ESA and I am in the Support Group. My husband and I both receive PIP. Am I right in thinking I am eligible for SDP now?
Also I was told as no one claims Carers Allowance for us we could actually claim a Carers Premium for each other along with SDP. This doesn’t seem right does it?
This is all very confusing and I really don’t want to rock the boat and jeopardise what I have.
Any advice would be gratefully appreciated.
Also can I just say to Gordon;

As long as you both now receive PIP Daily Living and no one else lives with you then you can claim the couples rate of the SD Premium, you will need to contact the DWP for this to happen and complete an IS10 form, it should be possible to do this while you are on the phone.
The following is an example of the form so you can see the questions that will be asked.

Whoever told you about the CA is incorrect, however, you can make a claim for CA against your partner's PIP claim. the CA will not be payable because of your ESA(CB) but a Carers Premium will be payable with your ESA(IR).
Your partner cannot claim CA as there is nothing stopping it being payable (from your post) and it would then stop one of the SDPs being paid making you worse off.
