You can do both, you should be able to add him to your ESA claim and he can still claim NS ESA which if successful will allow him to receive NI Credits which count towards the State pension.

ESA(IR) is dependant on your household income, your savings and assets, and for completeness any hours that your partner works. See

Asset and savings rule for ESA(IR)

24 hour work rule for ESA(IR)

Contact the DWP office dealing with your ESA claim, you will need to complete an ESA3, see the following example;

Thank you Gordon.

If eligible would we qualify for a SDP?

Sorry for all the questions but just want to know what I am talking about before talking to a person.

You would both need to be receiving DLA MRC or HRC or PIP Daily Living (there are others) AND have no other non-dependant living with you and for completeness, no more than one of you has someone claiming Carers Allowance against their DLA or PIP,

Hi,

I am receiving Legacy ESA CB and PIP at the minute. My husband receives New Style ESA and has just applied for PIP. No one gets Carter’s Allowance for looking after us or credits.
I was going to apply for Income Related ESA now but I am afraid they may try and force me onto New Style ESA if I rock the boat. The reason I am thinking about applying for IR ESA now is because my husbands redundancy money is now well below £10,000 in savings we have.
If I was able to do this would SDP automatically be added on to this or have they done away with this completely as I was never on it before or entitled to claim it before.

I would be very grateful for any advice at all. It is so hard to know what to do for the best. I put our details into some benefits calculators but they don’t seem to mention SDP at all.

Many thanks,
Jessica

There is nothing stopping you asking for ESA(IR) to be added to your existing claim, this will not result in your being transferred to New Style ESA.

Unless your husband already has a DLA MR or HR Care award you do not currently meet the criteria for the payment of the SD Premium, he will need to have an award of PIP Daily Living before you can claim the Premium. When he does contact the DWP and ask to complete an IS10 form it should be possible to complete the form over the phone.

The following has the questions asked on the IS10
