If I get refused PIP, could this affect my ESA ?

Hi . I have ESA with enhanced disability premium, which I won on appeal in a tribunal in 2016.
Last year I was sent another ESA assessment form, which I filled in with a supporting letter from my doctor . I sent it back and explained that I was also waiting for other supporting letters from specialists . They continued my claim as it is , before I had sent in my supporting letters from the specialists ,I got the letter telling me I still had ESA with enhanced disability premium, as before. But when I checked I was told I had only been given six months.

My question is this : Now I want to claim PIP . But I have heard that PIP is hard to get awarded.
If I get turned down for PIP , could the DWP reduce my amount of ESA, or , even stop my ESA?

If I fail to get PIP , or even fail an appeal on a claim for PIP, could the DWP take away my enhanced disability premium ?
As I have heard that the DWP is now using PIP claims to assess people’s ESA claims

Hi Helper***

There are plenty of claimants who only claim PIP or only claim ESA and a lot who claim both. They are different benefits and one is not dependent upon another. The DWP will not reduce your ESA payments if you do not claim PIP, nor do they reduce them if you fail to get it.

PIP is not easy to be awarded, but plenty of people are successful at it and we have some excellent guides which will walk you through the whole process.

In order to get the enhanced disability premium, you must satisfy the following criteria. As you do already, there is no reason why that should change.

Enhanced Disability Premium

To get this, you must be under pension credit age.

You must get the disability premium or income-related ESA, and one of the following:

PIP daily living component at the higher (‘enhanced’) rate
AFIP
DLA care component at the highest rate

You’ll also get this if you’re in the support group for income-related ESA.

There is one thing that is concerning me.

Apparently the government confirmed that the ESA85 medical reports - the work capability assessment medical report that is created if you claim Employment and Support Allowance (ESA) – are being used to make decision about PIP.

Apparently there are people who have successfully claimed PIP, who have been moved from the work-related activity group of ESA to the support group solely as a result of evidence gathered in the course of a PIP decision. So, it appears that the PIP reports are being looked at by the DWP and influencing poeples ESA claims.

I did not pass my original ATOS assessment for ESA. In fact , I actually passed though the system twice , failed two ATOS assessments, and lost my first appeal .

Like a lot of other people , I didn’t get nearly enough points to qaulify for ESA . And I didn’t have enough support for my first appeal .

However , I got this decision overturned , on the second appeal in 2016.

I have the enhanced disability premium. However , if the ESA and PIP reports are being looked at , and I fail to get PIP , could this affect my claim for ESA , as I falied the original ATOS assesment .

Has anyone heard of an ESA claim being demoted or reduced because of either failing or get PIP, or losing PIP after a review .
