Good Evening
Dib had her telephone Tribunal Hearing today. It lasted 45 mins. However she will have to wait for the decision of the tribunal to arrive in the post. I thought it might help others if I explain how the procedure worked. The Tribunal Service made contact a week ago to ask for a telephone number and that the Tribunal would take place at 10am. Dib gave her mobile number as she can put the phone onto speaker mode as I was going to be present as her carer and give her support.
At 10am on the dot Dib's telephone rang I put it on to speaker mode and a automated voice asked for Dib to speak her full name and press button to enter conference call.
The Judge Introduced himself then asked Dib some questions to ascertain her identity her and asked who else was in the room. He then informed us that they would be recording the hearing but we were not to record the hearing as it is an offence to do so after this he the asked the Doctor & Disability expert to join the Conference Call. They also introduced themselves. The questions then started regarding the initial Award letter, the Health Professionals Report, and how Dib's Physical & Mental Health issues affect her being able to complete the descriptors.
Dib was completely in bits at the start and I can honestly say that although we do not know the outcome of the Hearing we were both treated with respect and compassion by the Judge, Doctor and Disability Expert, they gave Dib time to try to explain and when she struggled they allowed me to answer on her behalf.

I had a bullet list as advised however, I assume different hearings take a different course. I was somewhat surprised at first as they were asking questions to which I had already responded to in my Written Statement to the Tribunal as the DWP were asking for the case to be dismissed. However about 15 minutes into the Hearing the Judge was handed this paperwork and while the Doctor & Disability Expert continued questions regarding their expertise the Judge was able to catch up with the Document.

I will update you when Did receives her judgement from the Tribunal. I would like to thank this site and all those to provide the help and sense of direction regarding this process.

The one thing that really stuck out during the hearing was the part of Dib's Appeal, that the Health Professionals Report and how incorrect the information was written by the HP and his failure to carryout a Physical Examination but then provide a full physical examination report. The Judge stated that they had many cases that this complaint had come up and that Dib was not the first and would sadly not be the last. Also the Panel asked Dib because she had waited 18 months for her appeal to be heard and the Appeal was therefore based on how Dib was 18 months ago on the day of her Assessment they were interested to know how much her Physical & Mental Health and changed from the date of the assessment, not sure how this will affect their decision but they obviously seemed interested.

So until the brown envelope arrives keep up the great work & stay safe

Best Wishes
Ant & Dib
