Hi guys, hoping you can help me out. If a job pays occupational sick pay for 3 months at full pay then 3 months at half pay. After this I assume it would go onto SSP if needed. During the 3 months of half pay, could a claim for ESA be put in if you are still unable to return to work or do you have to go onto SSP? Can you claim ESA whilst on SSP or do you have to wait until this runs out.
When you claim occupational sick pay your company will claim part of that back from the government, so you are infact in receipt of SSP, if your company's Occupational sick pay paid less that SSP then you would get a top up of SSP.
If you are still sick at the start of your 23rd week of your period of entitlement to SSP and likely to remain sick beyond the 28th week, you may claim UC and or/'new style' ESA depending on your NI contributions.
You will need a current fit note to claim UC and NS ESA.
