Housing benefit payment while being away

Hi, my father has been diagnosed with cancer. His cancer treatment has been delayed because of Covid. I’m from Germany and need to go there to be with him. I might be there longer than 4 weeks but am worried about the 4 week away rule for housing benefit. I receive PIP both enhanced and am in the ESA support group.
Could I come back for a week and then leave again? Would that reset the 4 week rule like with Visas? What if I simply don’t tell them? Thank you for your help!

We don't advise on Housing Benefit on the forum so you should take my advice with caution.

I can't see any discretion on the four week limits there are some exceptions but they do not apply to your situation.

There does not appear to be any specific aggregation of the periods you might be out of the country, so one period will not link to another, however, your Local Authority may argue differently especially if the period you have been away exceeds the time that you have been home, this is likely to apply to periods of 13 weeks or longer.

I can't tell you that you do not need to inform your LA if you go away for a period longer than four weeks, where other members have failed to inform a relevant authority, their situation has been far worse than what it would have been had they notified them.

Hi Gordon,
If one goes away for whatever reason during the pandemic. Would it not bring ones claim into conflict , situation depending. ie depending on what you had written down on your ESA and or PIP form to claim your benefit.

In other words, if one is on esa sg, and they go aw for 28 days, then your trackable s you have left the country and have to notify the authorities that you left the UK and when you come back you go into quarantine. Then the DWP could easily cross reference the databases and pick out those who are claiming benefits and then start ripping their claim to pieces. ie he/she stated they could not walk up one or two stair, dwp says but he/she managed to board a plane which meant climbing up 12 steps.

That would bring confliction to a claimants claims.

Or would they not cross reference passenger databases. Just wondering in advance that's all.

The question was in regard to Housing Benefit and I have only answered on this basis.

I would be surprised if Border Patrol staff has access to DWP information unless specifically requested.
