Had my ESA phone assessment was created by diane858
Hi Gordon
I had my ESA phone assessment yesterday,
He was a real gp who was very nice,
The phone call lasted 37 minutes
He went over my physical problems, severe pain and my fibromyalgia etc but didn't go over my mental health problems?
Though he did have my gps letter about my severe anxiety and he could hear the panic in my voice as i was a terrible mess, so maybe he thought there was no need? And in my panic i couldn't think clearly enough to ask? I hope this isn't a bad sign not being asked?
Anyway my GP surgery only rang yesterday teatime regarding a letter i had asked for last week, as she has amended and added much more information to the first letter regarding my depression and my inability to be able to cope with or talk to people due to severe distress, also my agoraphobia,, and has also put emphasis on my debilitating exhaustion, she also states that any work related activity would cause my conditions to be exacerbated,
They are not quite the words i had asked her to write but i am very grateful for her help
I think the receptionist must type and amend it to the way she fet was best so the words i asked for wasn't used,
I had actually asked for a New letter but they were trying to save me another £20
Can i now send this to the DWP and also can i ask for reg 29+35 to be considered as i didn't know i could have asked this to be taken into consideration on the ESA50?
And should i still email a copy to Maximus too?
As it is going to take weeks yet for a decision

Yes, send a copy to the DWP, I'm afraid you are too late to send it to Maximus as your file will have been returned to the DWP before they receive your letter.
You can ask for the DM to consider Regulations 29 and 35 but make sure that you fully understand the criteria for these as it is easy for claimants to fail to do this.
