i am unable to work because of illness i am on universal credit claiming sickness benefit, is it means tested, do i need to declare that my partner is in receipt of basic state pension,

There is no easy way to put this. If you are living with your partner as a couple then unintentionally or not, if you have not informed the DWP of their State Pension then you are committing benefit fraud.

UC is always claimed as a couple and you have either failed to tell the DWP about the pension when you claimed UC or if they qualified after you claimed UC that a Change had occurred.

You need to contact the DWP office dealing with your claim immediately, you can phone but follow up any conversation in writing.

There will be a recoverable overpayment equal to your partner's pension times the number of weeks that it has been in payment while you have been receiving UC.
