tribunal and new claim was created by lorry
hi,wonder if anyone can help.my partner won his last appeal at tribunal,but end date was nov 2020.now dwp has now informed him as date has gone he now needs to make new claim.we are both bit confused about this,any help would be appreciated,thankyou

Hi Lorry
It is common when a decision has been made by a tribunal when the award comes to an end the claimants are told to put in for a new claim. You should have received a letter asking whether you want to make a new claim before the date came to an end.

thanks for the reply, the tribunal in fact agreed with dwp and kept the award the same. because his award is finished now he had to make a new claim. he was under the impression it would be a award review not a new claim.his original claim in 2016 was a paper review migrating from dla. he also has a additional support marker on his pip file and is now worried about the forthcoming capita telephone assessment.

The problem stems from the fact that the DWP cannot supersede a Tribunal Decision so only a new Decision can be made.
