Can they really do this? was created by MexicanWave
Hi. My wife has recently received the PIP review form.As everything is slowing for the holidays plus we only have 3 weeks I asked for a two week extension which I was given. At the end of the telephone call the man said to return the form asap because it can take 7 - 10 days for the returned form to log onto the DWP system and they could cancel my wifes PIP and say we were too late. Is this true? Can they do this even if you have proof of postage and sent registered mail? It seems very arbritary and also unlawful.

Hi Mathev

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is.

Welcome to Benefits and Work .

We have heard on the forum of this happening, the DWP is a large organisation, there were problems during normal times, but we live in strange times which has exacerbated the situation, on the whole I believe DWP are doing a good job considering what they are going through.

You need to make sure that you send the forms back by recorded delivery. At this time of year post can be a bit erratic, I always contact DWP once I have sent forms of by RD just to let them know that the forms have been posted to them by RD which they can note on their record.

At the same time you could always ask for extra time to make sure your forms arrive on time if time is limited.

Hi, as long as you use a tracked postage service and print off the tracking receipt as soon as it is available and add to your file I cannot see DWP would have a leg to stand on. Every barrel has a rotten apple and it sounds to me like you just got someone with a twisted sense of getting satisfaction from bullying claimants - remember there are people out there who think we are all frauds and shirkers. But then that's just my own personal take.
Anyway best wishes with your wife's claim, I would say, don't allow them to pressure you into cutting corners.
Regards,
Denby
