ESA IR top up query was created by shwmae
a quick question - I've been on Contribution ESA but have been awarded a top up of ESA IR - however I see on my letter it doesn't refer to Contribution ESA now at all - it calls it all Income Related ESA? Is this correct or should it make reference to Contribution Based ESA too? The top up is only £1 a week so I thought it would be worded as a Top-up in addition to Contribution Based? Thanks in advance.

Hi Tabs
The question my be quick but the answer is a lot more complicated, especially as we do not have all the relevant information but I will try and give you an overview.
There are no premiums paid if you are only in receipt of CB ESA, as you have been awarded IR ESA, does not matter how much, you may now be entitled to claim disability premiums depending on your circumstances and what benefits you get, such daily living component of PIP, the group you have been placed in for ESA (WRAG or SG), whether or not you live alone or if you have a partner or grown up children, do they receive any disability benefits. There are lots of questions to ask before getting an answer.
Premiums are only paid with legacy Income Related benefits. You can also get free prescriptions when you receive IR ESA but not if you only receive CB ESA.
Remember CB ESA is only paid for 365 days unless you are placed in the Support Group.

ah sorry - yes I'm in support group and receive PIP - been on CB ESA since transferring from IB - as with thousands of others I received a form to complete to see if I should have been awarded a premium. I did also qualify for a small IR top-up (savings meant i don't get full premium) - as unknown to me they then used the figures on that form to look at this year too - so i didn't actually apply for a top-up. When I didn't get my usual £10 bonus for Christmas I looked at the award letter and could see no ref to CB ESA at all- (when I'd been awarded top-up I rang them and they had assured me on phone I am still on CB ESA and just get IR Top up)- letter just refers to "income related" throughout - I'm hoping it's just how they've worded the letter as I should definitely still be on CB ESA. Thanks for your help by the way!

Hi Tabs
Depending on your circumstances, you may be entitled to a Severe Disability premium, you would also be entitled to the enhanced disability premium as you are in the Support Group
www.gov.uk/disability-premiums/what-youll-get
There are two sets of requirements for the Severe Disability Premium.
First, to be eligible for the Premium, you need to be receiving a qualifying benefit such as the PIP Daily award that you have just received (there are others) you lived alone or were considered to be living alone and no one receives Carers Allowance against your PIP award or as a couple you can qualify if both you and your partner get a qualifying benefit (PIP daily living).
Secondly, to be entitled to payment of the Premium you need to be receiving an Income Related benefit such as ESA(IR), Income Support or Pension Credit but not Universal Credit.
You can continue to receive Contribution Based ESA indefinitely while you are in the Support Group.
