Hi everyone,

After a recent appeal, I was able to obtain the enhanced daily living component of PIP, yet despite correctly explaining how limited my mobility is, I did not obtain any points.

I have autism, Aspergers, anxiety, depression, ADHD and sensory issues, and many other conditions, but those are the ones which I feel most affect my daily life. I explained in my recent appeal that I am unable to use public transport due to finding it very overwhelming and difficult to try and figure out times and stops, as well as having panic attacks and feeling overwhelmed in a sensory respect, every time I have tried to take a bus or a train. I also explained that I have extreme difficult doing both familiar and unfamiliar journies, but explained if I’m driving this is not as much of an issue, as my car is my own personal environment and getting lost in my car is usually not too bad, as if I use a sat nav, it has to re-route a lot, but I often eventually end up at my destination. After passing my driving test at 17, and receiving a car off my parents, it has been life changing in more ways that I could have imagined, I was able to regularly attend higher education with good attendance, as well as use it as a portable environment to transport my sensory toys, and as a personal environment where I can control the different smells and get away from loud sounds. Before I had a car I pretty much didn’t leave the house and I could go and on about the ways it’s helped me, but I would be here for hours.

I tried explaining this in my letter, but it’s come back and not a single mobility point was awarded, I am extremely upset as I feel I fit the criteria, and to have a car on mobility meaning I would have a stress free method of transport would be priceless for me.

Does anyone have any experience with getting no points? Is there something I did wrong or didn’t include? Any advice or similar experience would be much appreciated, as I was not expecting to receive no points, as moving around is something I would say I struggle with more than daily living, so is there something I failed to say?

Hi Blue

I think you have fallen foul of some assessor attitudes to you being able to drive. You will need to apply to the Tribunal Services for a Statement of Reasons to see exactly how the Tribunal Panel came to their conclusions.

If you look at our Guide to PIP claims on page 58 - www.benefitsandwork.co.uk/help-for-claimants/pip#claims you will see what an Upper Tier Tribunal said about the need to assess people's ability to use Public Transport. You say that you can't and you will need to see if they considered this. I'm not saying that you would win, only that it may give you grounds to appeal

However, we are not experts in this area and I suggest you google for specialist mental health benefits advisors in your area.
