My son has been in receipt of Disability Benefits (DA/PIP and ESA) for the last 12 years as he has Hydrocephalus. He was recently required to have a telephone assessment which took place in mid-December and he was informed in a letter dated 14 January that his PIP would be discontinued on that same day. We have requested a mandatory reconsideration and laid out the case for this in a letter sent by Special Delivery a week and a half after receiving the decision. If unsuccessful with the MR, we will appeal as well.
My question is, whilst going through mandatory reconsideration and later the appeal process,, will my son continue to receive PIP or have there been any legislative changes since the UK has left the EU?
Unlike ESA which can be paid at the basic amount whilst waiting for an appeal, PIP is different, the decision usually takes effect from the date the decision maker takes action to change the decision.
