PIP Tribunal was created by jorgie2016
Hi folks,
Tried posting a few weeks ago but must have got timed out was raging as had been writing for a while, anyway I will try again,
Had appealed my pip award which was a move from DLA,had my F2F in March 2019,was moved to low mobility from high life
Award, moved from low care DLA to standard daily on PIP.Had a really bad time family wise, and getting supporting evidence so never
Put my appeal in till December 2019.My reasons for appeal being so late was excepted,DWP said my supporting evidence being MRI
CT scans were inadmissible as they were dated well past the F2F.The Tribunal said they were wrong as the Consultants letters related
To my condition at the time of the F2F,I got awarded Enhanced on both care and mobility,I was warned that it could have went the
Other way but i was determined to fight it.DWP were represented at the Tribunal which was done on the computer,I had a rep from
Advice Works as well who put her submission in,Tribunal was in mid January 2021 and got the review form in December then an extension letter week before the Tribunal giving me an award to December 2021,I never answered them,Tribunal back dated my award to date of M/C in April 2019 up to April 2023.DWP then lettered me after the Tribunal saying they would only back date to the letter extending my
Award as if it was a new case, then said after consideration would abide by the Tribunal Decision,Baffeld so was I,i’ve now had the money owed and letter with new rates,so thanks for the help and don’t give up,Consultant letters are a godsend as I think they swung it for myself
Also the Doctars report from my ESA claim which the M/C used but was in my favour as it totally contradicted the Nurse who done the
PIP F2F.
Regards

Hi Jorgie2016
Thank you for sharing your brilliant news. I am sorry that you had trouble posting earlier. Your perseverance has clearly paid off. This shows that if you stick with the appeals process there is a very strong chance that the tribunal will overturn DWP's decision. Additionally, getting assistance from a welfare benefits advisor will also boost your chance of success. Also, you weren't detered when DWP wrong refused to consider your consultant's reports. I just don't understand why DWP makes everything so difficult!

Well done again. All the best
