request for medical records time limit was created by Sophie1985
A family member of mine requested copies of their medical records in writing 40 days ago, the practice has acknowledged receipt of the request but are saying due to covid its taking longer, she needs it for her claim for AA, any idea if they still have a legal requirement to provide them during covid within a specific time?

Hello Sophie,
I would be most surprised if the use of Covid as an excuse has yet been tested at court. It seems to be the reason given for anything and everything which is running late. I currently have an FOI request out which they have told me is going to run late for exactly the same reason.
I think all you can do is write a very nice letter to the practice and explain why it is important for your relative to have copies of these records by a certain date and the adverse effect if could possibly have on her if her claim is not successful.
Sorry not to be able to more helpful, but 'can't because of covid' appears to be a universally acceptable excuse these days.
