Both my self and partner are currently receiving DLA middle rate care lower mobility we both get ESA with severely disabled increment. We are planning to get married soon, we have never lived together and don’t plan to live together once we married I live in a council house and my partner owns her own house I get housing and Council tax benefit, my partner is excluded from paying any Council tax as she has severe mental impairment and therefore is exempt from Council tax or water and sewage charges. Would being married but living apart have any affect to our current benefits..

Hi Alan

I have thought about your question, I don't believe that your benefits would be affected providing there was no change in your circumstances. Many married couples who split up can claim benefits in their own name. The question most members would ask is why get married, but that question is not for this forum.

I would advise you to seek help from a local welfare rights organisation to get a definitive answer to your question.

Hi all

Just waned to pick up on the mention of Council Tax SMI along with the exemption of water/sewerage payments mention by Alan.

Wondering if he, or anyone could please expand on the water/sewerage payment exemption please.

Hello petrocelli,

I have only ever heard of people getting an SMI exemption on water/sewage payments if they live in Scotland.

Perhaps Alan will confirm if he and his wife to be live north of the border.
