Hello Gary
Thanks for you reply, I have been awarded enhanced rate in mobility on December 2020. I am asking about LEAP case as I want to request for backdated from November 2016.
ON 23 November 2016 I was awarded standard rate in mobility in moving around (10 points) but nothing in overwhelming physical distress (please remember 23 November 2016, just 4 days before this case law). Now in December 2020 been awarded 4 points in overwhelming physical distress and I have been enhanced mobility rate.
As per your advice asking for backdating doesn't affect on my claim so want to ask can I request for backdated or not, from 2016 due to overwhelming physical distress, my condition is still like 2016 and also still same medication I was taking from 2016. Again most important is LEAP case law started from 28 November 2016 but my claim was awarded on 23 November 2016 (4 days earlier). Hope you understood me know I apologize for my English. Thanks

Hi Anees

Your English is perfect, no need to apologise.

Most backdates nowadays can only go back one month, what you need to ask for is an 'any time review', an any time review will go back to the start of the claim providing it was an official error.

You may want to seek advice from your local welfare rights worker, you can find your local Welfare Rights Worker to help you with looking at your LEAP case by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies.

I know very little about LEAP cases, we have had a few enquiries on this forum and Gordon has given some information to moderators which I gave you a few days ago.

The alternative is to contact DWP direct and ask.

Hi Anees,

I received a letter from the DWP late 2019 informing me that having looked at my claim again they would not be increasing my award. I challenged this and was successful so I would certainly ring the DWP and ask if your case has been reviewed or if its still in the queue!
You can challenge their decision in the normal way, MR and if necessary lodge an appeal.
I felt they had conveniently overlooked evidence that I had originally provided with my application and I was so pleased when the original decision was overturned.
The charity MIND offer excellent help and support should you need to challenge the DWP
Wishing you all the best ,

Gaddy

Hello Gary,
Many thanks for the advise so far.
My question is do i need to contact the DWP to be considered for the LEAP? I am currently on Enhanced rate of PIP both for Mobility & Care, do i need to prompt DWP for a review , so that i can be considered for a LEAP? or i had been considered already? Many thanks Charles

Hi caj279

My understanding of LEAP is that DWP are going through all the applications. We are getting mixed messages from the forum.

I personally would contact the DWP, in writing sent by recorded delivery and by phone. If you contact by phone or letter ask for an 'any time review', an any time review is based on an official error and will take the claim back to the beginning.
