Firstly Thank You for the help so far in getting the right award the guides were a great help.
Now I have a question that has been playing on my mind for a long-time but finding it not so easy to get an answer.
Even though I am now on an enhanced award of PIP for both parts for 10 years with a light touch review in December 2028 can I seek a revision or supersession on my award of DLA from 2007 which was just middle rate care as my conditions have not changed and remain stable as the PIP appeals case manager put it when he lapsed my appeal within 3 weeks of submission to HMCTS
Or is it a case that now I am on PIP all recourse to my previous claim to DLA has ended I would be grateful of any input one can give so I can move on.
A claimant has one year after a decision has been made to challenge an award and even then, they have to state why the challenge was not made within one month. DLA and PIP have different criteria and as many have found out their awards can vary considerably - some positively and some negatively. A mechanism does not exist to argue that because a claimant now has a specific award for PIP that they should have had a similar award for DLA - outside of the timeframe given above.
