Has anyone successfully challenged IAS? was created by Tuliptrees
Even though I have been successful at tribunal and got my PIP reinstated, I am still pursuing IAS for answers as to how the trainee assessors report could have/should have been relied on when making the original refusal. Indeed, the errors carried on right through two DM's and two IAS clinical experts. They refer to a condition I do not have, and never have had. Their responses to my questions fall far short of what a professional service provider should provide. So, it's off to the Independent Case Examiner. Does anyone have any experience they could share of going through this process?

Hi Margo

Unfortunately you are not alone and it seems to be happening quite frequently.

The feedback about ICE on the forum is that it can take quite sometime and the outcome can be disappointing.

Did you read our March news letter where a claimant has successfully sued Atos for negligence and failure of duty of care. Click on the link to see the article.

Morning. I have been pursuing a DWP complaint with ICE for over two years now!!
I did get a letter from ICE last year saying that they have asked the DWP to REVIEW DLA & PIP claims prior to 2016...Yay!!! ..... but to expect delays because of Covid.....
Still waiting for DWP response..
They will say ‘no’ at every turn... Just be a major pain in the A*** :-)

That helps,thanks. DWP has already made me a conciliatory payment on account of another error they made in their dealings with me, so even if ICE comes good, I still doubt anything will come of it. I have also reported the trainee assessor to the HCPC and they are investigating his online social media presence. I'm sure some folk think I should just let it go,but the treatment I have experienced and witnessed is appalling, so I intend to pursue.

Hi Gary, yes I did see this, good for her. I am taking the case to the HCPC and they are investigating, but the County Court option sounds good.

and found their legal volunteers on the phone extremely helpful and knowledgeable, and it is free!
