UC claim form confusing was created by Paulaspea
Hi, I ended my employment today for mental health reasons and started a claim for UC. It is saying i have to do a joint claim as i am married. He works full time and doesn't want to claim so how do i carry on the form without linking him ?

UC is a means tested benefit paid to people of working age who are on a low income which takes into account household income.

If you are one of a couple but claiming as a single person, in the calculation of your universal credit the standard allowance that applies in your case will be that of a single person, but your combined capital, earnings and income will be taken into account.
UC Regs, regs 3(3), 18(2), 22(3) & 36(3)

You may be eligible to claim New Style ESA depending on your circumstances. New Style ESA is a contributory benefit. Normally, this means you may be able to get it if you’ve paid or been credited with enough National Insurance contributions in the 2 full tax years before the year you’re claiming in.You would be making a claim on the basis that you are not fit for work so you will need to provide a Fit Note from your GP. www.gov.uk/guidance/new-style-employment-and-support-allowance
