ESA to UC following income increase

Hi,

Sorry if this is a duplicate post but I think perhaps the same post didn't go through over the weekend.

I've been elected as a local councillor in May's elections. I'm on IR-ESA with SG component and SDP. The role has no set working hours but due to the £13k a year income it is above what can be earned as permitted work. I think if I fulfil the same LCWRA criteria I would receive an amount of UC if I claimed that. Am I able to transfer from ESA to UC? If so how do I do this, and would my LCWRA carry over until another WCA is done?

Hi Ka

Sorry for the time you have been waiting for a reply, because this is really outside the remit of the forum and I would double-check with a specialist benefits advisor before you proceed with anything. Transferring from ESA to UC is simple (you only have to ask) - but you need to check what you would be entitled to.

Hi.
From ‘entitled to’ website re: ‘PERMITTED WORK’
work done as a councillor. Any payments over £143 (April 2021) will be deducted from your benefits

Does this mean if I earn over £143 it is no longer Permitted Work and I should move to UC, or that it still satisfies Permitted Work but I will have amounts over £143 deducted?

I cannot answer your question as I do not have all the facts, you need to talk to your local welfare rights organisation who can take all your circumstances into consideration. You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

Permitted work lets you:

~ work for less than 16 hours each week
~ earn up to £143 every week after tax
~ receive your normal amount of benefit
~ build up your skills and experience
~ be supported while you work – we call this supported permitted work
~ do voluntary work – there is no limit on how many hours a week you can do voluntary work for
