Hi All,
I have recently received a copy of my report for PIP from 2017.
Going through the report I am concerned that evidence was not taken into account by the HP - is their a time limit to challenge the descriptor choice that they made on a couple of activities?

Hi Pamela

Unless there has been a change in the law, you cannot challenge a report that is four years old. You have one month to ask for a mandatory reconsideration and up to one year to put in for a late MR - which the DWP can choose to accept or deny.

Is the one month for mandatory reconsideration from the date of the decision letter or the date it arrives?

HI Pamela,

I have always taken it as a month from the date of the letter. However, the rule is that you if you submit a MR within that month they have to consider. They have the flexibility to extend that to 13 months if you can present them with a good reason for being late. I have never known them to refuse to extend the time.
