Hello there, just after some friendly advice about the SDP.

I am on PIP both enhanced rates, ESA support group with EDP and no SDP, I recently moved into my brothers flat as I found where I was living originally was getting more difficult due to my disabilities, my brother offered me the option to move into his spare room which is all on the flat and no stairs to manovere.

I conatcted all the authrorities that needed to know my change of circumstances ie the local council and the DWP for benefit purposes which has gone without a hitch....so far. My brother also claims PIP at full rate both on both elements and ESA Support Groups with both EDP and SDP, and full Housing Benefit and Council Tax Support. A couple of days ago i recieved an IS10 form to fill out for SDP for myself which has now been sent off just waiting now.

I am just not sure if I would be entitled to it as I am classed as a non-dependant (over 18) and being a close relative to my brother, but I have also read that if both single people (closely related or not and over 18) and both on a qualifying benefit ie PIP Daily Living element, DLA Care middle or high rates then they are both entitled to SDP payment.

Before I moved into my brothers home I was not entitled to SDP as noone living there was entitled to a qualifying benefit like DLA, PIP or AA. The rules around the SDP are not very clear and quite complex. I have used an online benefit calculator and some have given different results to my enquiry. I also have used the Disability Rights Handbook 21 to 22 still uncertain about it. Hope someone can help or is just better to wait for the brown smokie envelope to arrive?

To be eligible for the Severe Disability Premium you need to meet the following criteria;

- You need to be receiving or entitled to (with the SDP) Income Related ESA
- You need to be receiving a qualifying benefit such as a PIP Daily Living award (there are other benefits)
- You need to be living alone or considered to be living alone
- No one must be receiving Carers Allowance against the qualifying benefit

In your case as you live with your brother who also receives PIP DL component then you would qualify for SDP.

If you look in the disability rights handbook look at page 132 section 3.

Thank you for the advice, it's appreciated. I have read those pages from the Disability Rights Handbook 21-22 (page 132 sec 3) just wanted some kind of clarification from someone else, so thank you. I will let you know what happens when I hear back from the DWP on this matter.
