good evening, could you please advise, I'm on esa income based because my husband is on my claim, in the beginning it was contribution based. my husband has been offered a job, would I be able to switch back to contribution based ESA and would doing so affect how much he could earn? We cannot answer your question as we do not have all your circumstances, you need to seek advice from your local welfare rights organisation, who can take all your circumstances into account. If you are on CB ESA and in receipt of the support component then this will stay in payment until you are re-assessed.
You say that you are now on IR ESA because your husband is on your claim, you need to check your claim as you could be claiming both IR ESA and CB ESA, if this is the case then when your husband starts his job your IR ESA will cease and your CB ESA will stay in payment, so you need to get advice, the information should be on your latest benefit breakdown letter from DWP which is usually issued Feb/March informing you of the benefit increases coming in April.
If you go back to just claiming CB ESA then your husbands income is not taken into account. Remember CB ESA is not means tested, whereas IR ESA is.
