Hi all
My relative was given a paper review assessment and awarded enhanced in both living and mobility for 2 1/2 years. Assessor suggest 1 1/2 years DM gave longer
Problem is the review form went in 1/3/20 was given enhanced living from standard. Her award starts first week in June this year. I thought she would be due backdated payment till last year
Have called and enquired to be told no payment due and could have mandatory consideration
Guessing they gave extra 12 months as trade off against backdated payment. Seems a bit underhand to me.
Any suggestions on next step please.

Hello Paul,

I would also have expected it to be backdated to 1/3/20 since the information they were considering was pertinent to that date.

She has the same ‘appeal’ options open to her as if she did not agree with the basic decision, I.e. MR and then if that fails an appeal.

I would suggest that she requests from the DWP their reasons for not backdating the award, and then you know what you are hitting at when it comes to preparing the MR request.

They’ve basically bullied and intimidated her to accept what she’s got. She is autistic and they obviously know that and know her fear would force to just accept it. She did same 3 years ago when given standard living and no mobility at first even after MR. Got advice from local law centre who told her to go to tribunal. Phone call couple of weeks later from DM offering full mobility if she doesn’t go to tribunal. She settled for that against advice of law centre. DWP know her medical needs and have played on them again. Disgusting tactics!!!
