ESA REASSESSMENT DWP & MAXIMUS PROBLEMS was created by louise
Hello,
My partners ESA date runs out on 10th July 2021, I haven't received a ESA50 form for my partner, so I contacted the DWP the other day, they said my partners claim is coming to end on the above date, so they will contact her local job centre to let Maximus know about a LIVE Referral straight away, it's been 4 days since that phone call, I contacted Maximus today, to say that I've now downloaded a ESA50 form online & filled it out in details, I asked them for there address so I could quickly send that in to them, they refused, as they said the DWP haven't made a referral for her still, I don't understand what is going on, what do I do now, as I'm going around in circles, her end date is approaching in 2 weeks time, has this happened to others on here before?
Kind regards

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi louise
We cannot answer your question as we do not know all the facts, such as;
1) What type of ESA was your partner claiming? IR ESA or CB ESA
2) If you partner was assessed, what group was she placed in? WRAG or Support
If your partner was in receipt of CB ESA and placed in WRAG then her claim will only last for one year, if she was in receipt of CB ESA and placed in the support group then her claim will last until she is next assessed.
I would advise you to contact your local Welfare Rights Organisation: You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

Hi Gary,
My partner has been on IR ESA for many years, always been in the support group after many reassessments over the years. but this time, the end date is only just 2 weeks away, no form sent from the CHDA as they say there is no Live referral from the DWP, Contacted the DWP about this 4 days ago & they just said they will contact our local job centre, i checked today with CHDA & they said still no Live referral. Just wondering if you have had this happen to others on here? as i can't understand what the DWP are doing.
Kind regards.

Hi louise
I cannot say that I have heard on the forum something similar happening, I would contact your MP for help and see if they can prioritise your case.
ESA is an indefinite award with scheduled reassessment based on the Prognosis Date completed by the assessor in their report, so your existing ESA award continues in payment until a new Decision is made.
My question would be, have you had an assessment and has a decision been made?

Thanks for the replies back, I have literally just sent a complaint to the DWP by email, as this is not something I've experienced before.
Kind regards,
