Hi
I am looking for the sample letters so that I can write to the DWP to see if my son can claim for activity 9 - Engaging With Others Face to Face. He was awarded 2 points in May 2017. The PA4 report at that time states that 'history of condition - sees his counsellor weekly' and he needs someone to go with him if he has an appointment.
On his review in June this year he was awarded 4 points for this activity. Nothing has changed from one period to another but on the 2017 review we probably didn't make it clear enough that he needed my support to attend appointment.

Hi Elie

I don't quite understand what you want to do. Your son was only awarded 2 points in 2017 for Q9. This time he was awarded 4 points for the same activity, which appears to reflect that you say he needs someone with him for social support. If you wanted to challenge the 2 points he was awarded in 2017 you should have done so within 1 month of the decision or 13 months if you had been putting in a late challenge. So there is nothing you can do now about the previous decision.

If you think he should have received higher points this time, you can put in for a mandatory reconsideration. You should read all the details how to do this in the Guide to Appeals (which also has details of the mandatory reconsideration - instructions how to do it and a template letter.

Hi Thanks for your reply. I was looking at your notes regarding the new court ruling where the dwp have to look at claims from 6 April 2016 for activity 9. They had been applying incorrect points for this activity. The benefit and works notes are headed DWP begins search for thousand of PIP claimants owed up to £13,000.
On page 5 of those notes it says you have created sample letters in the PIP section. I can't find those sample letters and was hoping you could point me in the right direction.

Am I right in requesting that the DWP look at my son's claim from 2017 given that the award has expired now and a new award has been given which includes 4 points now for activity 9?

Hi Elie

The Leap Review looks at where people had not been awarded any points or hadn't been awarded sufficient points for the psychological distress they suffered when undertaking a journey. I know you say that your son requires support, for which the DWP agrees and have awarded him points, but they didn't in 2017 or this year assess that it causes him overwhelming psychological distress. You can ask if he is eligible to have his case looked at. I can't tell you whether they will or not.
