LEAP review on PIP tribunal award? was created by martina.lindqvist
Hi everyone, apologies if the answer to my question is really obvious!
I got awarded 4 points for PIP mobility descriptor 1b ( Needs prompting to be able to undertake any journey to avoid overwhelming psychological distress to the claimant.) by a tribunal in 2017, but I think I should have gotten more points for this activity. I'm wondering if the leap reviews that the DWP is currently undertaking for this particular activity applies to me since my award was given by a tribunal and not by the dwp. As far as I'm aware my award has not been reviewed, and I'm not sure if I should pursue the matter or not.
Thanks for your help!

Hi Martina
As your decision came through a tribunal I think there is an assumption that they would have been aware of the new ruling and applied it to your case. However, you can always ring the DWP and seek clarification on whether your case is being looked at.

This was on Rightsnet today from one of the very experienced welfare advisors "DWP can’t revise an FtT decision, and can’t supersede one for error of law - so I don’t think there is anything they can directly do about it. It also isn’t really clear how DWP could try to assess an FtT decision to establish whether the MH or RJ decisions ought to have had a bearing on it, because they will have no information about the facts found by the FtT unless there happens to be an SOR and therefore no basis to conclude whether the decisions would have had a material impact on the outcome.."
It is quite a long thread and the link is
