M R Can they take points away? was created by sweetpea
I'm asking for a MR on the grounds that medical evidence concerning my severe migraines was ignored & also some of what I wrote on my pip form. I take numerous medications & have used a dosette box for many years. Without this I would forget to take meds. Can the panel take points away at a MR? I'm 2 points away from higher rate care. Hello sweetpea,

Yes they can take points away as well as give them. I have never personally come across them doing so and I seem to remember that one of the mods here said that they had only come across it twice and they were exceptional cases.

There was one person who I worked with who, in my opinion should definitely been given standard rate mobility and possibly standard rate daily living. He was awarded SR daily living (with just 8 points) and no mobility. He decided not to go for MR since the daily living award is higher than the mobility and he was not willing to take the risk. I am not convinced that was the right call, but it was his decision.

It is however the only time I have really cautioned someone about applying for MR. Remember too, if you can always challenge a MR decision at appeal.

Whenever I submit an MR request I include the things I agree with, as well as those I don’t.

Hi,

On my first claim for PIP I recieved standard rate care no mobility. I put in an MR as I believed they had given me the wrong points on a descriptor.

On my MR they gave me no points which I was very shocked about, however I went to tribunal and was awarded higher rate care and standard mobility.

So yes they can take points away but it is possible to change this at tribunal.
