Hi there,
After a lot of pondering, I phoned IAS/ATOS today to see if there was an update.
I was told that they needed to do a telephone assessment as they couldn't do a paper-based one as requested by my GP surgery.
I told the call handler if that was the case I wished to close my claim as there was no way I could handle an assessment over the phone.
I was then asked for my GP surgery phone number which I gave her and the name of the practitioner who had put in the request.
She said that they would be contacting my surgery for more information and would then write to me.
I've got really bad vibes now and am expecting the worst.
I gave them all the information they needed and my condition remains the same as when I was assessed as endorsed by my GP surgery.
I really don't know what to think now my head is in such a whirl.
Any feedback woukd be appreciated.

First let me say that you sound as if you handled the whole matter really well! Well done.
Hopefully when they ring your doctor they will support wbat they said in their letter and things will go smoothly from then on.
I don't think there is really anything else you can do at the moment other than brace yourself for a waiting game again.
If I was in the assessor's shoes I would assume that your willingness to forego your claim rather than face an assessment was support of your condition and therefore support of your claim. But that is just my view.
I hope you hear something good soon,

Thank you for your reply and kind words.
One thing I have done is emailed my MP and attached the supportive letter from my GP surgery, filled them in on what has happened so far, and give a background of my condition etc.
I requested that they contact the DWP on my behalf and put a stop to this silliness (obviously in more diplomatic terms).
Let's hope this helps, too.

I had a similar problem with a client who was awaiting a tribunal hearing. His health was poor, so GP confirmed that client was too ill to attend the hearing. The first tribunal insisted he attended and adjourned. I told them client wasn't going to get better. Anyway after 3 'failed ' hearings the tribunal finally got the message. There was no way I was jeopardising the client's health in this way.
There is I think an important point here. If your GP feels your health is too poor to attend in your case an assessment then there is a strong argument that it is disability discrimination. Under ECHR law, (Human Rights) there is right to be able to receive benefits. If DWP put unnecessary hurdles to effectively deny you access to benefits, then this could be a breach of the right to property.
Why not wait and see what happens. As Catherine said, I also think you have handled this very well and it will be interesting to see how this all pans out!

2. Make what is called a negative determination, which is when client doesn't comply with all the paperwork etc
3. Obtain other evidence from client's GP or other doctor then decide
If DWP make a decision that is unfavourable you can appeal. A negative determination can be appealed, or cancelled if the paperwork or assessment is then done.

Hi Phrank, good for you for drawing on the help of other people.
You could also inform the GP surgery of the updated position which will alert them they will be contacted by the DWP. This may hopefully lead to them writing a stronger letter on your behalf.
Just take it one day at a time and let it play out for now. I appreciate that is easier said than done as the uncertainty is very draining.

I will take your advice and see what happens for now. I had thought about dropping the DWP a line to update them on what has happened with IAS today and let them know I have written to my MP.
I suppose the the thing is: I got this information through a chance phone call so as yet have had no official letter from either IAS or the DWP -which in my book puts me one step ahead for now.
In other words, I am prepared for whatever comes next.
Hopefully sense will prevail!
