We have a client that is claiming ESA and Carers but then is getting deducted £30 a week from her ESA, she doesn't have debts or anything. Does anyone know what the deduction may be for.
Hi F.A.C.E.ba, I'm afraid that I don't know what this £30 is for. Why not ask DWP and or client fir a full break down of benefit? However, alarm bells are ringing! ESA can't be paid with carer's allowance. So you can't be too ill to work AND get ESA and then receive CA too. You can however receive a carer premium instead If your partner claims CA then you can be too ill to work and claim ESA, whilst ptner claims CA. Your ESA would then take into account the CA as income and ESA would be paid taking into account whatever couple rate and other premiums were available. I think also there could be a conflict with actually being a carer and claiming ESA. It will beg the question how can you not be able too work through ill health but are able to do 35 hrs caring per week? No it's not unlawful, but needs a lot if explanation. I think this client's benefit needs to be explored fully. Please make sure that there are no Overpayments being caused. I hope this helps. LL26
