Pip was created by Zoe052506
Hi I had a telephone medical assessment, I requested this to be recorded.
I received my copy of the recording as well as a text message saying DWP received assessors report.
Phoned and asked for a copy of the report

The report was full of inaccurate information, my carer then spoke to the adviser and requested the decision maker listens to recording due to inaccuracies within report.

2 weeks later I ring PIP to be told claim has been stopped as of 13th August.

I have sent all evidence in.
They acknowledge my conditions have progressed, but have stated that I have no mental health support other than one tablet a day being taken?
I said I try help my mental state by upcycling furniture, my carer clearly stated she does the manual labour I dictate to her what to do.
They have said I can't have issues with my shoulders or hands or fine motor if I enjoy upcycling and I have my children living with me, being their main carer.
Ignoring the fact my carer is my support she assists in every aspect.

Where can I go to get support with a mandatory reconsideration?
My 1st decision for PIP was rejected and had to complete a Mandatory Reconsideration.
That I was awarded standard both for 2 years.
This is the renewal I have been rejected for.

I've had aids installed into my home from OT, I pay private for acupuncture and they wrote a statement, my partners mum wrote a detailed statement outlining what she sees on a daily basis and the adaptions/difficulties I face, she had been a carer within care home setting for over 10 years.
My carer wrote a statement, I wrote a statement, sent all medical evidence I have.
Including ADHD diagnosis.

The assessor & decision maker both have stated that I am medicated for ADHD so it can not impact me?

Really need some support.
I've had my carer read the guides and highlight what I need to read.
I haven't got the mind set to fight over and over would like support to challenge this.

Thank you

Hi Zoe052506

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is

Welcome to Benefits and Work

I've moved your post to its own topic, we ask members not to post their questions in other member's topics as it can lead to the wrong advice being given or taken.

Now you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will now be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with.

If you need help then you may want to contact a local Welfare Rights Organisation, You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
