had an interesting conversation with a mandatory reconsideration DM last week was on the phone for an hour saying how my conditions affect me I have gone from no points to 10 points for daily living at Mr stage never thought I would win as I read on here not many people win at this stage I have severe depression and anxiety still only got 2 points for social support but happy so glad I didn't give up she took an old assessment of esa that I won at appeal strange decision as it's for pip not esa anyway backdated to May when they stopped pip so will get my severe disability premium back got the decision yesterday my question is should I have got 4 points for needing social support as per the change in the law not sure whether to wait till they contact me or should I question the extra 2 points that would take me to enhanced or wait and see if I get contacted love this site thanks for all you do

Hello Mark, and thank you for your kind words!

What a gruelling phone call that must have been, but well done, I hope you have given yourself a literal or metaphorical pat on the back and generally feel pretty good about yourself.

Any decision being made now will not be subject to a Leap Review – the DWP make new decisions in light of the ruling, so you can’t expect to have a letter about that.

Whether or not you should have been given another 2 points is not something we can possibly advise on. Have a look at the criteria for each descriptor, and then doing a reasonably harsh assessment do you think they have scored you correctly? If you think they have not, can you explain to someone else where they are wrong and why? If so, then you might want to consider going to appeal. I see you have done that before, so you know what is involved and only you can decide if it is worth the effort and whether or not your mental health is strong enough to deal with it.

thanks so much I have decided to wait it out I'm sure I fall into this category I.e 4 points for social support forgot to mention I have tinnitus and sleep apnea hope this helps other people not to give up kind regards
