Hi

I’ve just received my Assessment Report - which I requested after a telephone assessment; and I am really confused.

The first section of the report, which is a summary of what we discussed, is completely accurate.

But when it comes to applying that to the “criteria” it’s like I’m reading a totally different form.

On numerous occasions it states that not having a formal diagnosis or having a job is enough to “reasonably suggest I have no difficulties” — when in the summaries at the beginning (and in the medical evidence I submitted) it was very clear that I do indeed have difficulty and I am on the waiting list (which is 3 years long!) for a formal diagnosis.

In other places the reasoning is “has no upper limb injury” but gives no consideration to how my lower limb injury actually affects me.

In addition, she acknowledges a formal diagnosis of PTSD and my medication is clearly and accurately listed - in several sections she acknowledges my anxiety meds, but then on the question where it matters she said “no evidence of psychologiscal distress and is not on any anxiety meds” — which is (a) not true and (b) the total opposite of what she said one page before.

So my question is has anyone else experienced this? When the final decision came through had the Decision Maker picked up on these discrepancies? Do they look at the report as a whole or just the end of it?

I just don’t understand how one half of the report can be correct but then that information isn’t applied to the points criteria?!

Unfortunately this is a very common occurrence. You have a very small window of time, but you can write to the "Decision Maker" before your report comes out and point out the discrepancies. Yes, they should read the whole report but we know from experience they won't necessarily notice the discrepancies and the Decision Maker is not medically trained.

If you want to challenge this now, you can write to the address on your last letter from the DWP, address it to the 'Decision Maker' and question the contents of the report. Make sure that you query the most important points that could affect your final award.

This sounds very much like my report. I wrote a letter as suggested, and sent it to the decision maker, and got enhanced rate for both. I pointed out the bad things and then pointed out where on the report they where right. I strongly urge you to do the same. Don't forget to put your NI number on each page and say 'This is not a request a request for a mandatory reconsideration and you reserve the right to do one. I wish you good luck. Ellen

Hi Lulu, they did some slightly similar nasty stuff on our daughter's report. Please follow BIS's advice and write in ASAP, as doing so really made a difference for our daughter so it is well worth it. If you succeed you will hopefully avoid the need for the stress of doing an MR and likely then appeal.

Yes, it is sadly very common that there are discrepancies. Well done on getting the report. BIS is correct, you do have a window and it can be very helpful, to you, to get it registered that you don't accept the report. You are able to say that this isn't about the award (which you don't yet know) but the report itself.
This can be an important since it can mean that the decision maker is able to look at the report in a different way. Unfortunately, the current system is setup so that it is actually quite difficult to complain about the report.

Thank you everyone. I've done as suggested and written a letter which highlights the discrepancies in the report which is being posted by special delivery today -- hopefully that will help!!
