pip appeal was created by Steph
hi, i recently put in for a pip appeal, the dwp phoned me today and offered to give me enhanced daily living rather than standard however they said it would only go back to march (i think this was when the MR was done) rather than back to the review date which was in September 2021. i queried this and the chap i spoke to said he went back to his line manager and checked on this and was told to ask me at what date there was a change. i have a degenerative and progressive condition so i do not see what 'date' i could give them. so he said it could not be back dated. i do not see how this could be correct, when i filled in the review (that they sent me to fill in) that is what my condition was at that date and as i see it that is the decision that has not been amended to enhanced. i have lodged a complaint about them not back dating far enough and have said i will also appeal against the date once i have read the paperwork they send me. in the mean time i have accepted the other part of their decison. can you give any guidance on how to word my appeal though, when i write it?
on a plus point, appealing has increased my 'points' by at least 7 overall so it was worthwhile doing.
i would be grateful for any help here
many thanks

Hi Steph
Unless you reported a change of circumstances, then any changes in your benefits will take effect from the date of the decision, not from the review date.
Unfortunately we come your situation quite often on the forum.

I am going to appeal just on the date once I receive the paperwork from dwp with their revised decision. Do you have any ideas for good ways to explain that the changes were from the date I did my review? I said then that things had got worse for me I had mistakenly assumed that would suffice …

Hi Steph
As Gary said, you had to report a "Change of Circumstances" otherwise, the payment is from the date of the decision. Unfortunately, this is the system and there isn't a way around it.

hi, i appealed this and the dwp backed down before it went to tribunal, i received £2550! basically just reitterating that when i wrote my review that was the date of change and that that was the date i notified them. it was certainly worth going to appeal. my first appeal changed my daily living form standard to enhanced and the second got me my back money. just a word to others dont let dwp get away with what you know is wrong .. appeal
