No, it is not true re: holidaying and receiving PIP.

With regard to back payments. They are disregarded for 52 weeks and then they are considered as capital. Back payments that are over £5000 and are the result of an Error of Law, not an error of Decision, are disregarded indefinitely.

Hi Gordon, Thank you - that's good to know. As I mentioned, I don't go abroad, but you know what the press is like for selling papers! As for what you've mentioned about the back pay of PIP (lump sum) - does that mean that my UC shouldn't be affected as I've close to 8k remaining in the bank? The job centre have just messaged me to say that they'll let me know a decision in relation to my UC when they've made one. Just so I know whether to be deducted monthly or not? I couldn't honestly say whether it was an error of law or decision - it went to the courts tribunal and they awarded in my favour, so I'm assuming that would mean law ? Thank you.

No, you can't assume this, very few Tribunal decisions involve an Error of Law by the DWP.

Hi Gordon, Thank you for clarifying this. They word things quite complex, so I don't find it easy getting my head around the difference between the two, but at least I know now that my understanding of it is likely that my UC will be reduced. Thank you for your help - it's greatly appreciated.

Hi denise45 - Well I never realised paypal was now included. You know, some of the assessors come across really nice and helpful, but then when you get the report, you find out it's all just been to try catch you out, or say things that aren't true. My report was 29 pages long, and only 8 pages of it approx were correct. I would imagine if your backpay is less than a year old, that they won't take that into consideration as savings because I think from what I've been told on here, and read that you get a year - so if you've extra you need to get rid of, then why not look into things that may help you - a new bed for better sleep, vitamins you may need, kalms help at times......it's better in your pocket than theirs. Hopefully your report won't be as bad as mine was, and full of lies and incorrect statements about medication, exercise etc
