Is it normal for a GP to answers the set off questions as advice when she hasn't seen my daughter for over two years or over the phone consultation. Is the information in this questionnaire taken from her notes? The GP states that my daughter can take public transport or use a taxi? which counter arguments what we are questioning? They ask for facts rather than opinion? This is an opinion not a fact never in all the time has any doctor has asked my daughter how she has got to her appointments or discussed her travelling arrangements, we have always driven her, because of her anxiety with doctors and HP in the past and no reported memory problems? She has severe dyslexia, she always has memory problems Having to fight for help with her mental health, dyslexia, Endometriosis problems. Should we challenge this report before going to court or wait till the court procedures. I am trying to gather extra evidence re her main problem her Endometriosis which in her main problem which is having a effect on her mental health, we have a month to do this in i believe. She had her operation private not NHS so can we ask her private consultant for a letter explaining how bad her symptoms were before her operation (Which is in the time frame for her pip claim) but we might have to pay and will this look bad. I seriously dint think her case would get this far with all the u truths assessment?

The DWP still didn't send any information re the freedom of information act which was requested in writing on the 21st April or respond to my complaints letter. Next question they state that the information can only be taken into account within the stated appeal time ie one year ago. My daughter has submitted a diary entry after that date because her symptoms are coming back just to let the tribunal have an idea how she is struggling this year which was a lot worse when we submitted the form last year.

I hope this makes sense. Many thanks again. I wish i knew about this website before.

I think it is quite common for GPs to fill out forms they are sent from the DWP without any real thought and without putting in relevant information, such as they haven't spoken to your daughter for two years. And yes, it is common for them to give an opinion.

Yes, you should write to the Tribunal Service countering what your GP has said so that it is in the papers the panel will receive before the Tribunal. You can submit information up to three weeks before the Tribunal takes place.

Do get a letter from the Gynaecological Consultant. It doesn't matter whether she had the operation on the NHS or privately, and it doesn't matter whether you have to pay for a letter or not.

With the Dyslexia issues - send in info from the NHS website and a reputable Dyslexia website, making it clear that memory problems are a common symptom. Thankfully, the people on the panel should already know this - even if the assessor didn't!

It is true that they will only take note of the time when the assessment took place - because they are there to make a decision whether your daughter met the criteria then or not.

This has been a great deal of help and will put my daughters mind at rest a bit, she has gone down hill since the tribunal court appointment has been decided (mentally). I will do all these pieces off advice.
