Moving to Scotland from England was created by Gillian
Hi. I am on ESA contribution based and DLA (haven’t been invited to apply for PIP). I would like to move to Scotland. Can I be certain that my benefits will transfer to Scottish system without a reassessment or will they automatically reassess. I know I have to let DWP know my new address.
As a matter of interest how often would ESA usually be reassessed in Scotland.
Thank you in advance.
Gillian

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Gillian
Welcome to the forum.
You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum
I have absolutely no idea, you need to contact an advice agency in scotland who may be able to give you the information you are looking for;
www.cas.org.uk
www.mygov.scot/benefits-support

Purely moving to Scotland should not result in a transfer of your DLA to Adult Disability Payment as described below
The transfer process will start if the claimant reports a relevant change of circumstances, their DLA award is due to end or be renewed, or they ask to move to ADP. If none of these applies, then they will be transferred at some point as part of the managed transfer.
Although saying that I am dealing with a case where a client purely notified the DWP of a move to Scotland (reporting no other change of circumstances) who mistakenly started the transfer process and now going through the ADP change of circumstances process.
So if this happens suggest you consider a contact with a local advice agency in Scotland for help

Many thanks to you both. After several hours of hanging on the phone/web chat to Scottish government and DWP I think I have an understanding. ESA should be unchanged as it’s a simple change of address and the benefit hasn’t been devolved to Scotland. According to the DWP, although the DLA is now devolved it should not as you have mentioned trigger a reassessment unless it was an indefinite or 10 year review award or if there has been a change in circumstance/condition. The Scottish advisor was less sure. Saying that the assessors would look at it and decide whether to do a full reassessment based on information that they received from DWP and information that they ask from me. It may just be a form asking about any other change of circumstances.

Regarding your comment about advice from Scottish advisor - a bit confused
This would only happen if your DLA is transferred to ADP
