Managed Migration to UC when on ESA Support Group

Good evening,

I am going to be migrated to UC and I am on ESA Support Group.

It is my understanding, unlike I am mistaken, that:
- we all have to sign and commit to work commitments
- and it is down to the work coach who uses its own discretion as to what work commitment we have to commit to.

If anyone is on ESA Support Group can the work coach using its own discretion
(As we have agreed to work commitments as it is compulsory to sign) force anyone on esa support group to go to job centre on a regular basis and to look for work, seeing it is the work coach that is in power and uses its own discretion.

Many thanks
Best wishes

Hi Via,

In your case there should be nothing to worry about as far as the Work Coach is concerned.
That is because as long as the Migration is carried out correctly you will be transferred to the UC equivalent of the Support Group which is called LCWRA ( limited capability for work and work related activity ).
This means that your conditionality group for the Claimant Commitment is the No Work Related Requirements Group. So there is no requirement to attend the Jobcentre to look for work or prepare in the future for work.

Thank you so much David.
When transferred to the LCWRA ( Limited capability for work and work related activity) will I be obliged as transferred from ESA Support Group to sign something which I thought was compulsory to do when migrated to UC to commit myself to something related to work, even if on LCWRA?
Many thanks

Hi VIA

The transfer should be automatic when you sign your claimant commitment.

The conditions for claiming Universal Credit are set out in a "claimant commitment" that most people will have to accept at the beginning of their claim. If you are part of a couple, you will each have a separate claimant commitment that may be different from each other's.

People who may not need to accept a commitment include those who lack capacity, those who have exceptional circumstances  where it would be unreasonable to expect them to agree a commitment (this is decided by the work coach on a case by case basis), or, From 15 February 2022 people with a terminal illness and less than 6 months to live were also excluded, and from 4 April 2023 this was extended to 12 months.

 There are 4 conditionality groups:

* Group 1. No work related requirements
* Group 2. Work-focused interview requirement
* Group 3. Work preparation requirement
* Group 4. All work-related requirements

If coming from Support Group, is there a need to visit JCP to fill a claimant commitment, or is that automatic?

Hi BV

You will still need to sign a claimant commitment as you will be making a new claim.
